Terms of Service

These Terms of Service (“Terms”) govern your access to and use of TogetherChurch.app (the “Service”), operated by TogetherChurch (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Your account
You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for everything that happens under your account. If you create an account on behalf of a church or organization, you represent that you are authorized to bind that organization to these Terms.
2. Subscriptions, billing, and refunds
Paid plans are billed in advance on a recurring basis (monthly or annually) through Stripe. You authorize us to charge your payment method for the applicable fees, plus any taxes. Fees are non-refundable except where required by law.
You can cancel at any time from Admin → Plan & Billing. Cancellation takes effect at the end of the current billing period; you will retain access until then.
Usage-based charges (such as SMS and email messaging) are metered and billed based on actual usage at provider rates. We may change pricing with at least 30 days’ notice by email or in-app notice.
3. Ticketing and payments to churches
Paid tickets use Stripe Connect. Your church, not TogetherChurch, is the merchant of record for ticket sales, and your church is responsible for fulfillment, refunds, chargebacks, and tax reporting related to ticket sales. By connecting Stripe, you also agree to the Stripe Connected Account Agreement.
4. Your content and data
You retain all rights to the data you put into the Service, including your member directory, messages, and files (“Your Content”). You grant us a limited license to host, store, and process Your Content solely to operate, maintain, and improve the Service for you. We do not sell Your Content, and we do not use Your Content to train third-party models.
You are responsible for having the right to upload Your Content and for obtaining consent from members before sending SMS or email, as required by law.
5. Acceptable use
You agree not to:
- Send spam, harassment, or content that is illegal or infringing;
- Send SMS or email to people who have not consented or who have unsubscribed;
- Attempt to reverse engineer, disrupt, or gain unauthorized access to the Service;
- Use the Service to process regulated data beyond what is standard for a church management platform (e.g., no payment cards outside of Stripe, no protected health information beyond what is incidental to care coordination).
We may suspend or terminate accounts that violate these rules, with or without notice.
6. Child data and kids check-in
Kids check-in is provided to help churches safely manage children’s programming. Your church is the data controller for child records. You agree to use kids data only for the legitimate purposes of operating your church and to follow applicable laws (including COPPA in the U.S.) in how you collect parental consent.
7. Third-party services
The Service integrates with third-party providers, including Stripe (payments), Twilio (SMS), and Amazon Web Services (email delivery and hosting). Your use of those integrations is also subject to their terms. We are not responsible for outages or defects of third-party services.
8. Availability and changes
We strive to keep the Service available, but we do not guarantee uninterrupted uptime. We may update, improve, or modify the Service from time to time. If a change materially reduces functionality on a paid plan, we will give reasonable notice and allow cancellation.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR SECURE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOGETHERCHURCH WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You will defend and indemnify us against any claim arising from Your Content, your use of the Service in violation of these Terms, or your violation of applicable law.
12. Termination
You may cancel at any time. We may suspend or terminate your access if you materially breach these Terms. Upon termination, your data will be retained per our retention policy described in the Privacy Policy; you may export data before cancellation.
13. Governing law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in North Carolina, and you and we consent to that jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify you by email or an in-app notice before it takes effect. Continued use after the effective date means you accept the updated Terms.
